Ads.com, Inc. Infringement Notification Policy

The following policy sets forth the process by which any third party who believes that their trademark and/or copyright is being infringed may request that Ads.com, Inc. (“Company,” “we,” “us,” or “our”) remove the allegedly infringing trademark and/or copyright.

Advertisers and Members, as well as third party service providers (including other monetization services) are responsible for the content they place on a webpage through or via a domain name, not Ads.com, Inc. Company does not host domain names, provide webpage content, or any other similar services.

Nevertheless, Company takes infringement complaints seriously, but we may only take action on requests that are complained of by the copyright and/or trademark holder or their authorized representative (e.g., a legal representative or other representative for a copyright or a brand) and such complaints must be for REGISTERED copyrights and/or trademarks.

Capitalized terms used but not defined in this Infringement Notification Policy are defined in the General Terms of Service.

Trademark Infringement Claims

Company investigates trademark complaints that are brought to our attention by trademark owners or their authorized agents, but we do not act as an intermediary in third party disputes. Instead, trademark owners must bring or settle disputes directly with Members or advertisers.

Notwithstanding, trademark owners may follow the steps below to submit a complaint to us.

Trademark mark complaints must be bona fide. Otherwise, we will not take down use of your trademark on our Site, Services, and/or Programs.

We only accept trademark complaints from bona fide trademark owners or their authorized representatives, as follows:

  1. If your email address domain matches a corporate domain or website.

  2. If you are an attorney, we will accept Attorneys of Record as listed on trademark registrations. Your email address domain must match your or your law firm’s website.

  3. If you are not the trademark owner or the Attorney of Record as listed on trademark registrations and are, for example, an attorney not listed on trademark registrations, media agencies, or licensed partners and distributors, bona fide trademark owners must provide explicit authorization for these entities to act on their behalf and you will need to upload when you fill out the complaint form either a power of attorney or a signed statement from the trademark owner on their company letterhead that confirms that you are authorized to act on their behalf regarding trademark matters when you fill out the complaint form. The authorization should not include conditions such as an expiration date, territorial restrictions, or other limitations.

After we review your complaint, we'll send a response to the email address you provided letting you know the outcome of our review.

We review trademark complaints in the order in which they are received. We will contact you after we have investigated your complaint. If you have questions related to your complaint, please be sure to contact us at support@ads.com.

If, after we conduct our trademark investigation, we find that your complaint is valid, we may restrict use of the trademark on our Site, Services, and Programs but Company is not a judge or jury and further action may be warranted by the trademark owner against the alleged infringement.

Company reserves the right to disable or terminate accounts of users who infringe third parties’ copyrights and/or trademarks on our Site, Services, and/or Programs.
